Solicitation of Interest in Chapter 13 Mortgage Loan Modification Program - Comments Accepted through March 8, 2019

Dear ECF Users:

As you may be aware, the Bankruptcy Law Section of the State Bar of Texas established a
Committee to develop a state-wide mortgage loan modification program for use in chapter
13 bankruptcy cases.  The Bankruptcy Court for the Western District of Texas is in the
process of evaluating whether to implement such a program.  A factor in that
consideration is whether the Bar is interested in participating in this program.

The goal of the program is to streamline the mortgage loan modification process.
Participation in the program is voluntary for all parties and not required.  The
completion of required documents, exchange of documents and information, and requests
of the parties for additional information will be handled through a virtual portal.
This program is suitable for either a conduit or non-conduit case and will provide the
Chapter 13 Trustee with the information he/she would need to make correct disbursements
to mortgage lenders, whether the loan is modified or not.  Attached to this email is a
summary outline provided by the Committee describing how the proposed program is
designed to operate.

We are soliciting (1) interest in participation in the mortgage loan modification
program and (2) comments regarding the design and implementation of the mortgage loan
modification program from all district-wide ECF Users.  You are invited and encouraged
to participate in this comment period, beginning January 23, 2019 and ending on March
8, 2019.  All submissions should be emailed to ch13loanmod@txwb.uscourts.gov.
