Procedure for Cash Collateral

Budgets attached to cash-collateral motions, DIP-financing motions, or plans must show budgeted incomes and expenses tied to a period of time—for interim cash budgets, a time period spanning at least the thirty days after the petition date, and for final budgets, at least thirteen weeks after expiration of the interim budget. Plan budgets must similarly show dated revenue inflows and expense outflows for the duration of the plan. It is insufficient to provide a single weekly or monthly budget that purportedly applies to each week (or month) over the course of the applied-for period. A single weekly (or monthly) budget does not accurately account for the appropriate timing of anticipated revenue inflows and expense outflows. Rather, budgets submitted or filed must be tethered to the actual dates on which the debtor anticipates each revenue inflow and expense outflow will occur.
