In re Longoria (Jan. 15, 2009)
Issue: Whether there was sufficient propriety and adequacy of service of Contempt Order for violation of Motion to Show Cause and Request for Sanctions such that it is enforceable, and whether CAC violated the automatic stay?
Holding: The Court finds that CAC had notice and an opportunity to be heard, and its Constitutional due process rights are not violated by finding the Contempt Order to be valid and enforceable, and sanctions should be imposed on CAC for failure to fully and timely comply with the Contempt Order and violating the automatic stay.
