COMMENT PERIOD EXTENDED TO MARCH 2, 2017 - Texas Western District Wide 13 Plan and Order Adopting

The Bankruptcy Rules Committee has concluded that a national form chapter 13 plan (Form 113) will be required in all chapter 13 cases. The expected deadline for this national form plan to go into effect is December 1, 2017. Fed. R. Bankr. P. 3015(c) allows a bankruptcy court to adopt one uniform plan for its district. The Judges for the Western District of Texas, along with consultation of all of the Chapter 13 Trustees, have reached a consensus on a District Wide Plan that will be used in all chapter 13 cases once the District Wide Plan goes into effect. Additionally, the Judges have approved an Order Adopting the Plan. The comment period for making any comments to the Plan and Order Adopting Plan is thirty days. Any comments that you wish the Court to consider must be made no later than March 2, 2017. Please email your comments to Ch13_DistrictPlan@txwb.uscourts.gov.  After the Judges have reviewed all the comments made to the Plan, it is possible that further revisions may be made to the Plan.
