Procedure for Obtaining a "Perfected" Summons from the Court

Format of Proposed Summons

The front page of the summons submitted for perfection should be the same for every defendant in the case, regardless of whether the summons is being issued or reissued. The style should reflect Plaintiff 1 (et al.) v. Defendant 1 (et al.). Also, the bankruptcy case number and adversary case number should be shown on the front page.

Obtaining a "Perfected" Summons

There are two basic ways to obtain a "perfected" summons(es) from the court.

1. You may present to the court (via mail or in person) the original and one copy of each summons you wish to have "perfected." The court will date, sign, and seal the original(s) and return it/them to you, either in person at the intake counter or by mail if you provide the court with a return addressed envelope with postage.

2. Attorneys who are CM/ECF users can electronically request that the court issue "perfected" summonses by docketing the Summons Request event. The PDF document to be attached during docketing is the front page of the proposed summons (only one page). The court will print the attached PDF on a form that contains the certificate of service on the back, and then will date, sign, and seal the number of summons(es) requested. The court will then mail the "perfected" originals back to the requesting attorney.
